General terms and conditions.

General information about www.avangardgold.ro.

1.1 The website www.avangardgold.ro hereinafter referred to as the (Web)site, is an online shop administered by Avangard Gold System SRL., with its registered office in Bucharest, Strada Vulturilor nr 18, sector 3, Romania, registered with the Trade Register under number J40/9565/2022, Tax Identification Code 46164206, hereinafter referred to as the Administrator of the site.

The main activity of the company Avangard gold System SRL includes the Manufacture of jewellery and similar articles of precious metals and stones.

Foreign exchange and money transfer operations are carried out by the company Avangard Money System SRL with its registered office in Bucharest, Strada Vulturilor nr 18, sector 3, Romania, registered with the Trade Register under number J40/3016/2018, Tax Identification Code 38957740

Insurance operations are carried out by the company Avangard Asigurări System SRL with its registered office in Bucharest, Strada Vulturilor nr 18, sector 3, Romania, registered with the Trade Register under number J40/3418/2022, Tax Identification Code 45691089.

1.2 “Order” means any online order placed by the “Buyer” and/or “Client” with the company through the website www.avangardgold.ro

“Seller” means the online shop on the website www.avangardgold.ro, administered by Avangard Gold System SRL.,

“Client” means the natural person / legal person or any legal entity that places an order on the website www.avangardgold.ro.

“User” means any natural/legal person who, by placing an order, has agreed to the clauses specific to the site in the section “General terms and conditions”.

1.3 The website www.avangardgold.ro and Avangard gold System SRL which administers the online shop, operate in accordance with the Romanian and European Community legislation in force.

1.4 The purchase of gold coins and bars, as well as of all other items intended for sale, and the use of any information contained in the site, implies unconditional acceptance of all these terms and conditions.

1.5 Avangard gold System SRL has the right to amend these provisions at any time, depending on changes to the Romanian legislation in force or to its internal regulations, with the obligation to publish them on the site before they actually apply, so that they are visible to the users of the website www.avangardgold.ro.

 

 

Use of the website www.avangardgold.ro.

2.1 You may use our Site only for lawful purposes and in accordance with these Rules and other documents applicable to the services provided through the Site.

2.2 The Buyer is solely responsible for obtaining any equipment or ancillary service needed to connect to, access or use the Website, including, without limitation, hardware and software equipment as well as telephone and data services.

2.3. By registering an Order on the Site, the Buyer agrees to the form of communication (telephone or e-mail) through which the Administrator conducts its commercial operations. For justified reasons, Avangard Gold System SRL reserves the right to change the quantity of the Goods in the Order. If it changes the quantity of the “Goods in the Order”, it will notify the Buyer at the e-mail address or telephone number made available to the Seller when the order was placed and will refund the amount paid if payment was made by card or by bank transfer.

2.4. The Buyer agrees to the following:

- not to reproduce, duplicate, copy or retransmit any parts of the Site in breach of legal requirements or of the provisions of these general terms and conditions;

- not to gain unauthorised and unlawful access to, damage, modify or interrupt: - parts of the Site or of its content; - servers, equipment or networks where information belonging to the Site is stored; - databases related to the site; - services that are accessible through the Site; - software used to operate/protect the Site; or - equipment, networks or software owned or used by third parties.

- not to carry out actions intended to disable, damage or circumvent the measures used by Avangard Gold System SRL or by a third party to protect the Site, the services and the materials provided through it, as well as the servers, systems or other equipment associated with them;

- not to use any technical means, scripts, programming languages, software or other invasive methods to disrupt the normal operation of the Site or of other Users, nor to attempt to decipher, decompile, distribute or program any type of software that contains or copies a part, segment or module of the Site;

- when placing an order on the site, to submit correct, accurate and true information about yourself and to update the information already published in a timely manner;

- when using the services of the Site, including, but not limited to, publishing content on the Site or taking part in forums, blogs, chat rooms or any other type of communication with other Users of the Site, not to publish, send or transmit materials with content that is illegal, threatening, false, misleading, fraudulent, obscene, offensive, defamatory, libellous, pornographic, uncensored, that incites the use of violence or other illegal and immoral acts, or that harms the honour and dignity of other Users or the name and reputation of the company Avangard Gold System SRL

- not to use the personal information of other Users accessible through the site for purposes other than those indicated in these Rules, and not to disturb the normal working process or cause any form of harassment or distress to other Users, including, but not limited to, by sending an excessively large number of messages or messages with threatening, defamatory, insulting or obscene content;

Security of the website www.avangardgold.ro.

3.1 The details provided by the Buyer while accessing the site or placing an order must be correct and complete. Access for the purpose of placing an Order is permitted to any Buyer. For justified reasons, the website www.avangardgold.ro and the company Avangard Gold System SRL , reserve the right to restrict the access of the Client/Buyer for the purpose of placing an Order and/or to some of the accepted payment methods, if they consider that, based on the conduct or activity of the Client/Buyer on the Site, his or her actions could harm them in any way.

3.2 The Buyer must declare that he or she is the beneficial owner of the gold coins/bars and of the other products purchased from the site.

Prices and payment of online orders.

To place an order, the Buyer must agree to the terms and conditions displayed on www.avangardgold.ro. The order will be confirmed by SMS or e-mail.

The promotions displayed by Avangard Gold System SRL in the online shop are valid while stocks last and/or during the period specified.

Online orders placed on the website www.avangardgold.ro can be paid by:

Cash on delivery

Online card payment

Bank transfer to the Avangard Gold System account.

Cash on delivery

The Buyer pays for the products ordered when they are delivered and will receive a receipt for the payment from the agent of the courier company. The procedure applies to both natural persons and legal persons. Payment is limited to 10,000 (ten thousand) Ron for natural persons and 5,000 (five thousand) Ron for legal persons.

Card payment.

When paying by card for orders placed on www.avangardgold.ro , the Buyer will have to fill in the details requested by the online payment processor, namely:

Card number

Card expiry date: month and year

CVV/ CVC code: the security code of 3 or 4 digits found on the back of the card

Name of the cardholder

The transaction itself takes place on the secure page of the online payment processor ……….., the data entered by the client being confidential and accessible, in encrypted form, only to the payment processor.

Avangard Gold System SRL is not responsible for any fees charged by the bank for transactions made by the client.

Avangard Gold System SRL does not charge the Buyer any fee for card payment of orders placed online.

Payment by bank transfer

Payment is made to the account of Avangard Gold System SRL opened with Banca Transilvania, Iban RO12BTRLRONCRT0646987501. The order will be shipped after we receive the amount in the account. You will receive a confirmation e-mail when the order has been shipped.

If the coins, bars or other products ordered are not available, the Buyer will be notified by Avangard Gold System SRL, using the contact details provided, and will be able to:

wait until the products ordered become available;

Or

cancel the Order; in this case, the amounts collected from the client are refunded within a maximum of 3 working days.

Delivery.

5.1 Delivery will be made to the address specified by the Buyer or to one of the Avangard Gold System SRL locations, depending on the option chosen when placing the Order. The Buyer must be present when the Order is received, prove his or her identity with the identity card used when placing the order, and sign for receipt. The price, the payment method and the payment term are specified in each Order. The Seller will issue the Buyer an invoice for the Goods and Services delivered, the Buyer being obliged to provide all the information needed to issue the invoice in accordance with the legislation in force.

5.2 Avangard Gold System SRL will ship the Order within a maximum of 2 working days for products in stock and a maximum of 20 working days for products that are out of stock. However, it will not be responsible for delays not directly attributable to it, such as weather disturbances, heavy traffic, mechanical or other failures occurring during transport, or any other case of force majeure. All information used to describe the Goods available on the Site (static / dynamic images / multimedia presentations / etc.) does not represent a contractual obligation on the part of the Seller and is used for presentation purposes only.

5.3 The delivery and insurance fee applicable to your order will be clearly shown in the Order confirmation. If you choose to collect from the premises of Avangard Gold System SRL, the delivery and insurance fees do not apply. In the case of online payments, Avangard Gold System SRL is not/cannot be held responsible for any other additional cost borne by the Buyer, including but not limited to currency conversion fees applied by the bank that issued the card of the Buyer, if the currency in which the card was issued differs from RON. Responsibility for this lies solely with the Buyer.

5.4 Ownership of the products ordered through www.avangardgold.ro will be transferred to the Buyer at the time of delivery, provided that the full value of the Order has been transferred to the account of Avangard Gold System SRL, paid online by card or paid to the delegate of Avangard Gold System SRL or to the representative of the transport courier.

5.5 Deliveries will be made to the Buyer only once the full value of the Order has been received in the account of the Administrator, in the case of orders paid by bank transfer. The order is considered accepted only after the full value of the order has been collected, in the case of orders paid by payment order (OP). By sending the Order, the Buyer agrees to receive invoices in electronic format, added by the company Aurom Metal Investment S.R.L. to the Account or sent by electronic mail to the e-mail address stated in his or her account.

Order cancellation and product returns.

6.1 The Client/ User/ Buyer has the right to cancel the order at any time between making the advance payment and the delivery of the Order, by contacting us by telephone on 0759 650 688 or at the e-mail address office@avangardgold.ro Any order that has not been paid within 48 hours will be automatically cancelled if payment by bank transfer was selected.

Products (gold bars, gold coins) purchased from the website www.avangardgold.ro cannot be returned.

6.2 The right to return products purchased by the Client/ User/ Buyer from this online shop, conferred by Ordinance OUG 34/2014 on consumer protection in the conclusion and performance of distance contracts, does not apply in this case, in accordance with Government Ordinance no. 130/2000, Chapter II, Art. 10, letter b.), because the products supplied depend on fluctuations in the financial market and therefore constitute an exception to this right.

 

How to buy from www.avangardgold.ro

To begin purchasing products from the shop online, the Buyer must select the desired product, the gold bar or the coin.

After finding the desired product, the Buyer must press the Add to cart button. Each desired product will be added to the shopping cart.

In the shopping cart you can add or remove products as you wish. You can continue shopping or go to the Checkout step.

Checkout step. The Buyer checks the product or products he or she wishes to buy and then places the order.

Making the payment. The full name of the Buyer, the full address and the CNP (personal identification number) are entered. For legal persons, the details of the company are entered. All purchases of investment gold require the personal data of the Buyer in accordance with the law in force. Select your preferred payment method: Cash on delivery (payment on delivery), Card payment or Bank transfer.

   

Data confidentiality.

7.1 Avangard Gold System SRL is required, under Law no. 129/2019 on preventing and combating money laundering and terrorist financing, and amending and supplementing certain normative acts, to apply complex verification measures to its Clients before carrying out an occasional operation or transaction, and is required, regardless of the value of the occasional operation or transaction, to identify all its clients, as well as the beneficial owners, where applicable. In the identification process, Avangard Gold System SRL is required to request official identification documents for all identifiable persons.

7.2 The privacy policy sets out how our company uses and protects any information that the Buyer provides to the website www.avangardgold.ro.
